DWI and the driver's license points system in New York

DWI comes with many penalties, such as high fees, jail time and the loss of your driver's license, which is one many people overlook, not realizing the long-term effects of a drunk driving conviction. Without a license, you may have trouble getting to work, school and other such places, or spend a lot of time and money on public transportation and car sharing services.

Understanding the consequences of a DWI on your driving privileges in New York may be the motivation you need to avoid getting into such a situation.

Driver Violation Point System

When you commit a traffic offense and receive a conviction for it, you acquire points on your New York driver's license. The number of points depends on the nature of the violation.

For example, going no more than 10 mph over the speed limit is only three points, whereas going more than 40 mph over the speed limit is 11 points. Most violations fall between three and five points.

If you accumulate 11 points over 18 months (based on violation date, not conviction), you are at risk for a license suspension and may have to pay fines. However, you can take a course through the Point and Insurance Reduction Program to avoid a suspension.

A DWI conviction does not add any points, but this is because the crime leads to an immediate license suspension or revocation. How long it lasts depends on the details of your case and if you receive a conviction, with the duration increasing with the number of the offense.

Even refusing to take a chemical test can lead to the loss of your license. You may be able to fight the suspension or apply for a conditional license for work purposes after completing an Impaired Driver Program depending on the circumstances.
