Have You Been Charged With A Serious Crime?

What is “fruit of the poisonous tree?”

If you are facing criminal charges, one legal doctrine you should be aware of is known as the “fruit of the poisonous tree” doctrine. While it does not apply to all cases, it can have a significant impact when it does.

Essentially, evidence is considered the “fruit” of the tree, with the “tree” representing the process by which the evidence was gathered. If the tree has been poisoned — meaning the evidence was obtained illegally — then the fruit is also tainted and must be excluded from court.

How this may occur

To illustrate the concept behind this doctrine, consider an illegal search conducted by the police. Suppose officers knock on a homeowner’s door, do not receive consent to enter and force their way inside. If they do not have a search warrant, their entry is illegal. This poisons the tree.

While inside the home, the police may discover substantial evidence, such as:

  • Pictures or videos of criminal activity
  • Illegal drugs and large amounts of cash
  • Unregistered firearms
  • Stolen goods

This evidence might otherwise be used to convict the defendant. However, because it was obtained through an illegal search, it is often inadmissible in court. If the prosecution’s case relies entirely on this evidence, and it is excluded, the odds of a conviction plummet.

Legal defense options

This is just one possible legal defense strategy when facing serious charges. However, it highlights the importance of understanding the legal process and knowing what steps to take in these situations.

If you are facing serious charges, a conviction could lead to jail time, fines and much more. Having experienced legal guidance can help you consider all of the defense options you have to protect your future.
